NGDJ - Terms & conditions

Eligibilty

The Next Generation DJ contest (“NGDJ”) is open only to registered members of Letsmix.com who are 21 years of age or older. Proof of indentification may be required. To be eligible for the first prize, Non-U.S. residents must hold a valid passport and must be legally authorized for travel to the United States. Employees of Tonium and any additional participating NGDJ sponsors and their immediate families are not eligible to participate in the contest. No purchase is required for entering NGDJ. A purchase or use of Tonium’s or any of the NGDJ sponsors’ products will not have any impact of bearing on your chance of winning.

Stage 1

The NGDJ eligibility period will begin December 15th 2009 and will end on January 31st 2010, after which Stage 1 (“NGDJ Qualifiers Eligibility Period”) ends. To register and compete in NGDJ, visit http://www.letsmix.com and fully complete all required fields on the online registration form, and proceed to upload your DJ mix. Spread your NGDJ submission widely; you must gain a minimum of 200 ratings to be deemed a qualifier. The top one hundred qualifiers will then be determined by their average mix rating to remain in contest as Stage 2 commences.

Stage 2

Beginning January 31st 2010 only the top one hundred qualifiers will remain in competition (“NGDJ Top 100 Eligibility”). Only the Top 100 contestants remain eligible for competing for the NGDJ prices. To remain in competition, contestants in Stage 2 will be required to upload a second DJ mix, based on a theme decided by Letsmix.com and announced on Letsmix.com at the beginning of Stage 2.

Winners

From the mixes in Stage 2 (“NGDJ Top 100”), a jury from Letsmix.com will select the winners, ranked 1-50. The winners will be announced on Letsmix.com before March 2010.

Mixes submitted for NGDJ are bound by the terms and conditions for Letsmix.com available at http://letsmix.com/terms_of_use. All other terms and conditions set for the in the terms and conditions shall remain in effect.

Next Generation DJ - Process

Participation in NGDJ requires submitting a DJ mix via Letsmix.com, using the Mp3 Upload function or the Letsmix Editor. Only one mix per Letsmix.com member may enter the contest in Stage 1, however a second mix will be required for those participating in Stage 2 of the contest. To qualify for the NGDJ Top 100, a mix needs to acquire at least 200 ratings during Stage 1, along with having one of the hundred highest rating averages.

Anyone with a valid e-mail address may vote (“rate”) on the submitted mixes. The e-mail address must be submitted with each vote. A maximum of one vote per person is permitted. All voting will be subject to verification and certification by Letsmix.com. No automatic, programmed, or similar means of voting are permitted. Participants who do not comply with these Terms and Conditions, or who attempt to interfere with the voting process or the operation of the website in any way will be disqualified and their votes will not be counted. Letsmix.com reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend voting should any virus, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the voting process. All decisions regarding the voting process are final and will not be subject to challenge or appeal.

Letsmix.com, its affiliates and partners are not responsible for any technical, hardware, software, or other malfunctions, errors or failures of any kind, lost or unavailable network connections, web site, internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of mixes and/or voting information (regardless of cause) or failed, incomplete, or delayed computer transmissions which may limit one's ability to submit a mix and/or a vote, including any injury or damage to participant's or any other person's computer relating to or resulting from participating in the competition and/or voting process. Letsmix.com is not responsible for lost, late, invalid or technically corrupted mixes and/or votes, which will be disqualified. Letsmix.com shall use commercially reasonable efforts to ensure the security and accuracy of all mixes and/or votes and the competition process provided, however, that you acknowledge and agree that such methodologies are not infallible, and that Letsmix.com makes no guarantee as to their effectiveness. All votes and/or voting data become the sole property of Letsmix.com and will not be acknowledged or returned.

Any attempt by a participant to intentionally damage the website or compromise or manipulate the competition process may be a violation of both criminal and civil laws. Letsmix.com reserves the right to seek damages to the fullest extent permitted by law from any such person attempting to do so.

General Conditions

The NGDJ organizer (Letsmix.com) reserves the right to rescind, change or modify the vote and/or rating minimum for the contest. If such a decision is made, the decision will be broadcast and published on this website. Decisions of NGDJ judges are final. Prizes are non-transferable/non-redeemable for cash. No substitution of the prizes is allowed. Winners are solely responsible for any and all local, state and federal taxes and customs charges. Winners may also be required to sign prizewinner documents and/or waivers. Winners must show proof of identification including social security number and may be required to sign an affidavit of eligibility and release. By participating in this contest, participants grant Letsmix.com, Tonium, Pioneer Electronics, Thrust Publishing Ltd the right to publicize and/or broadcast the contestant’s name, character, likeness, voice and the fact that he/she has participated in and/or won the contest without additional compensation. Contestant participation also grants permission to use pictures and/or likeness and voice recordings on websites associated with this competition.

By participating in this contest and/or accepting any prize in this contest, the winner releases Letsmix.com and it's owners, officers and directors plus any additional sponsors from any and all liabilities associated with this contest and/or said prize.

Letsmix.com reserves the right to discontinue the contest at any time for any reason without notice. In the event that this happens, Letsmix.com officials will pick finalists at their own discretion. All decisions are final. Letsmix.com reserves the right to change the rules at any time without notice.

No responsibility is assumed by Letsmix.com or NGDJ sponsors for damaged, lost, altered, misdirected, postage due, incomplete or illegible entries, phone or mechanical failure, human error or any act of nature which may prohibit voting or participating in this contest.

In the event that a contestant is found to be ineligible for a prize, said prizes will not be awarded. No substitution or transference of prizes by winner is allowed.

Unless otherwise specified, all prizes will be mailed to winners. Letsmix or NGDJ sponsors are not responsible for delay in delivery or for any prizes lost in the mail. Some prizes may be timely or size may be of concern. Winners have 30 days to claim their prizes, if the prize goes unclaimed it will be returned to the prize closet. Should the first prize winner for any reason not be available to participate in the NGDJ shows as prompted by Letsmix.com, a replacement will be picked by Letsmix.com. Precise times for travel arrangements are to be mutually agreed between Letsmix.com and the NGDJ winner. The NGDJ winner agrees to apply, pay and provide for all applicable Visas and/or working permits.

Legal Conditions

Next Generation DJ, commonly known as ”NGDJ” is the copyrighted property and trademark of Tonium AB (“Letsmix.com”). Letsmix.com has the sole and exclusive right to reproduce, manufacture, copy, sell, display images of and publish said trademark in any size or medium, whether in three or two dimensions, and to distribute or exploit the brand or reproductions of same by gift, sale, license or otherwise. No reproduction, replica, drawing, photograph, derivative work or other copy of the NGDJ logo may be made or used by any manufacturer, advertiser, organization or individual except in accordance with these regulations or under express written license from Letsmix.com.

“Letsmix” and “NGDJ” are the registered intellectual property of Tonium AB and may not be used except in accordance with these regulations or under a special written license from Letsmix.com.

NGDJ winners have no rights whatsoever in the Tonium AB copyright or in its trademark registrations. Winners must comply with these rules and regulations.

News and editorial uses of Tonium AB symbols and marks in stories and articles appearing in newspapers, periodicals, digital publications, web sites are subject to the following condition: all published representations of the NGDJ trademark, including photographs, drawings and other likenesses, must include the legend “© Tonium AB” to provide notice of copyright.

Governing Law

All issues concerning the construction, methodology, validity and enforcement of these Official Rules, or the rights and obligations of the entrant and Sponsors, shall be construed and governed by the laws of Sweden, without regard to conflicts of law. All suits or claims brought in connection with the NGDJ must be brought in a court in Stockholm, Sweden.

Force Majeure

Letsmix.com reserves the right to terminate the competition, prize awards and/or decline the NGDJ winner to perform at any NGDJ scheduled shows in the event of any reason beyond the control of Letsmix.com including, but not limited to, illness, injury, detention, strike, lock out, war, fire, serious or dangerous weather conditions, national calamity, Acts of God, Order of the Local and/or National Government or Local licensing or Health Authority, actual or threatened riots or civil disorder or any reason including, but not limited to, faulty or insufficient premises or any other dangerous condition which, in the opinion of Letsmix.com officials, may result in damage to equipment or danger or injury to the any person. In any such event, neither Letsmix.com or the NGDJ winner shall be entitled to make any claim against the other party for non-fulfilment of any outstanding obligations yet to be performed on the part of such other party.
